A spouse's pending ITIN application does not automatically extend your tax filing or payment deadline. The right federal process depends on whether you are applying with a return, waiting for an already submitted application or eligible for a different filing method. California must be checked separately; do not invent a temporary identification number.
Establish the filing situation first
An Individual Taxpayer Identification Number (ITIN) is for people with a federal tax purpose who are not eligible for a Social Security number. It does not establish immigration status or permission to work. Before preparing Form W-7, confirm whether the spouse is eligible for an SSN and whether an ITIN is actually needed for the filing situation.
Married filing jointly is not simply a way to solve a missing number. If a spouse is a nonresident alien, a joint filing election can bring worldwide income and other reporting consequences into the US return. Review residency, income sources and election history before choosing a status. Your spouse is not your dependent.
Assemble the federal application and return
- Identify the W-7 application reason and whether an exception to attaching a federal return applies.
- Prepare the required return or exception evidence using the current W-7 instructions.
- Check identity and foreign-status documents; ordinary photocopies generally do not replace originals or issuing-agency-certified copies.
- Choose a permitted submission method and retain a complete copy and delivery evidence.
- If an application is already pending, check its status and instructions before sending another package or duplicate return.
A passport may establish both identity and foreign status, but the application category and circumstances still matter. Ask about permitted in-person document review or an authorized acceptance agent before mailing an original document you will need for travel. Confirm the agent's actual authorization rather than assuming any preparer can certify documents.
Treat California as a separate task
The California Form 540 instructions tell filers with an issued ITIN to enter it in the SSN field. That instruction alone does not establish what to enter while a first ITIN is still pending. Confirm the current pending-ITIN procedure directly with FTB or a preparer using that year's instructions, including payment identification and any follow-up after issuance.
| Item | Why it matters |
|---|---|
| Federal application receipt and submission date | Establish what has already been sent. |
| Federal and California deadlines | An extension of filing time generally does not extend payment time. |
| Estimated tax and withholding | A balance can remain due while the number is pending. |
| Issued ITIN notice | Check the name and number before completing later filings. |
Questions while an ITIN is pending
Can we use a made-up SSN temporarily?
No. Use only the authorized process for your actual filing situation. A placeholder can cause identification and processing problems.
Should we submit another W-7 every time we call?
No. Keep the first submission's records and follow the IRS instructions for checking status or responding to a request. Avoid unnecessary duplicate packages.
Does a pending ITIN stop penalties automatically?
No automatic filing or payment extension follows merely from applying. Review deadlines, extensions, estimated payments and any applicable relief separately.
Does joint filing always give the best result?
No. Residency elections, worldwide income, credits, state rules and joint liability need consideration. Compare the complete consequences before signing.
